聚合链接行为的著作权法与反不正当竞争法适用的冲突与解决

The Conflict and Solution of Copyright Law and Anti-Unfair Competition Law on Aggregated Link Behavior

聚合链接是指视频聚合平台将分散在各网站的内容集中起来,应用加框链接技术使用户在一款产品中就可以搜索并观看所有视频资源。聚合链接改变了作品呈现的方式、超出著作权人的控制范围,损害被链方的利益,造成著作权人、被链网站、设链者的利益分配极不平衡,导致大量纠纷产生。通过对确定加框链接接行为性质的三种观点的分析认为“服务器标准”易导致聚合链接行为的著作权法与反不正当竞争法的适用冲突,因此,解决冲突的主要方式是应当坚持“实质呈现标准”;通过修订著作权法,扩大信息网络传播权的范围,合理地规制聚合链接行为。

Aggregated link refers to that the video aggregation platform centralizes the content scattered in various websites,and the application of framed link technology enables users to search and view all video resources in one product.Aggregated links change the way works are presented,beyond the control of copyright owners,damage the interests of the linked parties,resulting in the imbalance of the interests of copyright owners,the linked websites and link service providers,resulting in a large number of disputes.Based on the analysis of three views on the nature of framed connection,the author thinks that"the server standard"can easily lead to the application conflict between copyright law and anti-unfair competition law.Therefore,the main way to solve the conflict is to adhere to"the substantive presentation standard",expand the scope of information network dissemination right by revising the copyright law,and regulate the aggregated link behavior reasonably.
