国家级新区司法创新的法理及其限度

Jurisprudence and Limits of Judicial Innovation in State Level New Areas

国家级新区既是区域经济发展新高地,也是区域法治发展新引擎。近年来,各国家级新区基于先行先试权进行司法改革创新探索,在司法机构设置、内部人事管理和审判流程优化等方面日益取得新进展,并呈现出不同的实践类型。国家级新区司法创新有着基本的法理依据,是对新时代社会主要矛盾变化的司法回应,是对“两个积极性”原则的司法落实,遵循着顶层设计与先行先试相结合的发生路径。同时,国家级新区司法创新也必须遵循基本的法治限度,包括坚持司法权中央事权属性,遵循法律保留原则的要求,遵循法治改革试点授权程序,还要避免造成新的司法行政化地方化倾向。

The state-level new areas are not only a new highland for regional economic development,but also a new engine for the development of regional rule of law.In recent years,all state-level new areas have carried out judicial reform and innovation exploration based on the right empowered to carry and try in ad⁃vance,and new progress were made in the establishment of judicial institutions,internal personnel manage⁃ment and trial process optimization with different types of practice presented.Judicial innovation in the statelevel new areas has basic legal basis,which is a judicial response to the major contradictions in the new era,and which is also the judicial implementation of the“two positive”constitutional principles,following the path of the combination of top-level design and prior trial.At the same time,the judicial innovation of the statelevel new areas must also follow the basic rule of law,including adhering to the central authority of the judicial power,following the requirements of the legal reservation principle,following the judicial reform pilot authori⁃zation procedure,and avoiding the new tendency of judicial administration and localization.
