论市场监管举报制度的困境与出路

On the difficulties and solutions of the report system of market supervision

虽然市场监管举报制度在我国广泛兴起,但其在实践中不仅未能实现“强化治理能力”与“落实行政民主”的预期目标,更是引发了“弱化行政能力”与“异化行政民主”的消极后果。受权利话语影响的制度设计思路缺乏可行性与正当性,是导致制度陷入困境的真正根源。为摆脱制度困境,应当以“权利—义务”结合型设计思路为指导,在内容上形成全新的制度重构方案,在程序上由全国人大及其常委会选择“理想型”或“现实型”的制度重构方式。

The report system of market supervision is widely developing in China,however,it is failed to achieve the expected goal of strengthening governance capacity and implementing administrative democracy in practice so far,furthermore,it is caused the negative consequences of weakening administrative capacity and dissimilating administrative democracy.The lack of feasibility and legitimacy of the design idea formed under the influence of power discourse is the root of the system’s predicament.In order to get out of the system predicament,it is necessary to form a new system reconstruction scheme based on the combination of rights and obligations,and then,in terms of procedures,the NPC and its standing committee should choose the“ideal”or“realistic”system reconstruction method to implement the scheme.
