监察法治视域下党规、国法的衔接贯通

On the Connection between Party Rules and State Laws from the Perspective of China’s Supervision Law

党的十八届四中全会把党规纳入中国特色社会主义法规制度体系,为党规、国法衔接提供了法理依据。党的十九届四中全会决定“加快形成完善的党内法规体系”“推进法治中国建设”。在监察体制改革的宏观背景下,纪检类党内法规体系建设取得了长足的进步。在党的纪律检查委员会和监察委员会合署办公的模式下,纪检监察机关要从案件管辖、留置措施及其证据标准衔接、案件移送等方面入手,强化党规、国法的衔接贯通。

The 4th Plenary Session of the 18th CPC Central Committee has incorporated party rules into China’s socialist legal system with Chinese characteristics,providing a jurisprudential basis for connecting party rules and state laws.Meanwhile,the Party has decided to"accelerate the formation of a sound system of party rules"and promote the rule of law in China.Against the background of supervision system reform,party rules have undergone great progress.Under the mode of joint office of CPC’s disciplinary inspection commissions and supervisory commissions,the two organs should act carefully in respect of case jurisdiction,retention measures,the link of different standards of evidence,case transfer,etc.,and strike a balance between party rules and state laws.
