网络暴力行为成因及可能触及的法律问题研究

2019年相继出现的明星自杀事件让网络暴力再一次成为讨论热点,网络暴力也随着互联网的发展变得形式多样,难以规制。结合《网络信息内容生态治理规定》将网暴行为界定为形式多样的违法行为。通过对司法大数据以及典型案例的研究发现,实施网络暴力可能会触及以刑法民法为代表的法律问题,对此应当加强网暴相关法律知识的宣传普及;网络平台监督版块的运营效果并不能达到保护网民合法权益的目的,相关部门应尽快建立更加完善的反“网络暴力”的监管机制。

Successive star suicide incidents in 2019 has made cyber violence a hot topic again.Cyber violence has also become more diverse and difficult to regulate with the development of the Internet.In combination with the Regulations on the Ecological Governance of Network Information Contents,cyber violence is defined as a variety of illegalbehavior.Through study on judicial big data and typical cases,it is found that the implementation of cyber violence may touch on legal issues represented by criminal law and civil law.In this regard,the promotion and popularization of legal knowledge related to cyber violence should be strengthened.The operation effect of online platform supervision section cannot be achieved.For the purpose of protecting the legitimate rights and interests of netizens,relevant departments should establish a more comprehensive supervision mechanism against cyber violence as soon as possible.
