摘要
员额制司法改革以来,司法职业化和司法专业化取得积极成效的同时,也出现员额制催生的利益冲突致使精英化后劲不足、法官的“行政化倾向”造成司法资源浪费、保障机制不完善致使法官缺乏职业认同感等一系列现实问题。为进一步强化司法改革成果,应该在员额制度框架基础上,采取全面去行政化、强化法官精英化与专业化、增强法院人员职业认同感、健全法院人事配套机制等相应针对性措施,实现司法资源与司法能效紧密结合。
Since the judicial reform of the post system,judicial professionalization and specialization have achieved positive results.At the same time,conflicts of interest caused by the post system have resulted in insufficient stamina for elites,judges“administrative tendency”has caused a waste of judicial resources,and imperfect guarantee mechanisms has led to judges lack of professional identity.In order to further strengthen the achievements of judicial reform,corresponding targeted measuresshould be taken on the basis of the post system framework,such as comprehensive de-administration,strengthening the elitism and specialization of judges,enhancing the professional identity of court personnel,and improving the supporting mechanism of court personnel,so as to realize the close combination of judicial resources and judicial energy efficiency.
