新冠肺炎疫情应对对国际人道主义救援立法改进的思考

Legislative improvement on international humanitarian relief based on COVID-19

本文通过案例研究及实证分析国际人道主义救援法缺失的历史原因与现实困窘。对近期重大国际人道主义灾难救援中出现的问题进行了归纳总结,分析了国际人道主义救援行动的诸多问题都可归结为立法缺失或不完善。最后对国际人道主义救援立法改进提出进行了讨论。

This paper analyzes the lack of international humanitarian relief law from the perspective of historical and realistic predicaments by means of cases study and empirical analysis.Challenges emerged in the recent major international humanitarian reliefs are summarized,which can be attributed to the lack of legislation or ill-defined law.At last,the improvement measures in response to international humanitarian relief law are proposed and discussed.
