摘要
民族地区教育治理法治化是民族地区教育治理现代化的方式和目标之一。一方面,它体现出规范民族地区教育治理秩序、协调民族地区教育发展利益、保障民族地区教育发展正确方向等独特价值。另一方面,它具有充分的实践基础,纵向看体现出民族地区教育法治进程的历史延续性,横向看体现出民族地区教育法治内容的共性与差异性,发展地看体现出民族地区教育治理目标对内生发展趋向的认同。新时代推进民族地区教育治理法治化还需要破解民族地区教育治理民族性与现代性冲突的观念难题、教育法治建设滞后的制度难题、社会力量参与教育发展动力不够的机制难题,以及民族地区教育自我发展能力不足而教育需求多元化高质量化的目标难题。从法治维度推进民族地区教育治理现代化,需要确立民族地区教育内生发展的法治目标,健全民族教育法律法规体系,构建民族性与现代性深度融合的教育治理法治实施路径,注重民族教育立法后评估。
The legalization of education governance is one of the measures and objectives of the education modernization in ethnic areas. On the one hand,it embodies the unique values of standardizing the order of educational governance in ethnic areas,coordinates the interests of educational development in ethnic areas,and ensures the correct direction of educational development in ethnic areas. On the other hand,it has sufficient practical basis,which shows the historical continuity of the process of education legalization in ethnic areas,the commonness and difference of the content of education legalization in ethnic areas,and the recognition of endogenous development trend in the goal of education governance in ethnic areas. In the new era,it is necessary to solve the problem of the conflict between ethnicity and modernity,the systematic challenges behind the retarded process of education legalization construction,the mechanism problem of lack of momentum in social forces participation in the development of education,and the goal to fulfill diversified and high quality education demand with insufficient education self-development ability. To promote the modernization of educational governance in ethnic areas from the legal dimension,it is necessary to establish the goal of endogenous development of education in ethnic areas,improve the legal and regulation system of ethnic education,and construct the implementation pathway of educational governance legalization with the profound integration of ethnicity and modernity while paying attention to the post-evaluation of ethnic education legislation.
