论我国强制隔离戒毒程序中存在的问题及对策

On the Existing Problems and Countermeasures of China’s Compulsory Drug Rehabilitation Program

我国强制隔离戒毒制度在打击违法吸食毒品中起到重要作用,但自2008年《中华人民共和国禁毒法》实施以来的12年间,我国强制隔离戒毒制度暴露出的问题日趋明显。该制度饱受争议的原因是其通过行政手段便可限制人身自由长达3年之久,而该制度所配套的程序却存在诸多问题亟待解决。从戒毒程序的决定程序出发,指出调查程序中违法侵犯行政相对人的权利、行政主体违法拥有强制戒毒决定权以及期限变更程序中诊断评估不合理等情况,深入剖析每个问题并分别提出相应的对策和建议:合理调整行政权力配置,明确成瘾认定标准和完善诊断评估制度,增加行政相对人程序性的权利,加强司法机关对决定程序的监督。通过上述举措来保障行政相对人的程序性权利,完善强制戒毒程序。

China’s compulsory drug rehabilitation system plays an important role in the fight against illegal drug use,but since the Narcotics Control Law was put into force in 2008,the problems exposed by the compulsory isolation rehabilitation system in China has become increasingly obvious.The system is controversial because it can restrict personal freedom for three years through administrative means,and there are many problems to be solved in the organized process of this system.This article points out that the investigation procedure violates the rights of administrative counterparts in the decision-making of rehabilitation program,the administrative bodies illegally make compulsory isolation decisions,and the diagnostic assessment in the time limit modification program is not reasonable.After an in-depth analysis of each problem,countermeasures and suggestions are put forward,including adjusting the administrative power configuration,clarifying addiction standards,improving the diagnostic evaluation system and increasing the administrative counterparts’procedural rights,and strengthening the supervision of judicial authorities in the decision process,so as to guarantee the procedural rights of administrative counterparts and improve the compulsory rehabilitation program.
