摘要
近年来,陕西省各地勘单位进行了事转企改革,随之而来的不光是经济提升发展,还有因各种转企转制原因带来的信访问题。结合地勘单位实际情况和自身实践经验,依据相关法律法规和部门规章,从“诉访分离”的概念、程序、方式方法等方面进行了分析。认为贯彻落实“诉访分离”制度,需要经办人员掌握信访管理相关规定和诉讼程序法相关知识,从案件的甄别分离入手,做好信息告知和司法衔接,依法依规处理相关信访问题,把涉法涉诉信访纳入法治轨道解决。推动“诉访分离”制度发挥实效、化解纠纷,可以提升信访工作的法治化工作水平。
In recent years,the geological prospecting units in Shaanxi Province have carried out the reform of transforming public institutions into enterprises,which brings not only the economic development,but also the petition problems caused by various reasons.Combined with the actual situation of geological prospecting units and their own practical experience,according to the relevant laws and regulations and department rules,the concept,procedure,mode and method of“separation of complaint and visit”are analyzed.In order to implement the system of“separation of complaint and visit”,it is necessary for the handling personnel to master the relevant provisions of petition management and the relevant knowledge of procedural law,start with the separation of cases,do well in the connection between information disclosure and judicature,handle the relevant petition problems in accordance with the law and regulations,and bring the letters and visits involving law and litigation into the orbit of the rule of law.Promoting the system of“separation of complaint and visit”to achieve effective results and resolve disputes can enhance the level of rule of law work in letters and visits.
