失信惩戒举措在政务处分中的引入——兼论《中华人民共和国公职人员政务处分法(草案)》的不足与完善

摘要 失信惩戒举措作为惩治失信行为的有效手段,既未在我国政务处分领域实现充分推广,也未能在曾发布的《中华人民共和国公职人员政务处分法(草案)》中得到应有体现。由于我国政务处分存在处分方式单一、惩罚力度不足、预防功能缺失的固有症结,故有必要将该举措引入公职人员政务处分体系并将其法治化。通过明确失信惩戒举措规范地位、修改政务处分方式、增设操作性规定等措施,使公职人员失信惩戒的内容有效融入未来的政务处分法制体系,以实现政务处分科学化的目标。 As an effective means of punishing dishonesty,the punishment measures for dishonesty have not been fully promoted in the field of administrative punishment in China,nor have they been reflected in the law of the People′s Republic of China on Administrative Punishments of Public Officials(Draft).Due to the inherent problems of single punishment,insufficient punishment and lack of prevention function,it is necessary to introduce this measure into the administrative punishment system of public servants and legalize it.Then,through clarifying the status of the punishment measures for dishonesty,modifying the way of administrative punishment,and adding operational provisions,the content of the punishment for breaking faith of public servants can be effectively integrated into the future legal system of administrative punishment,so as to achieve the scientific goal of administrative punishment.
