摘要
新修订的《土地管理法》已于2020年1月1日起施行,集体经营性建设用地入市是此次修订的最大亮点和重要成效。《土地管理法》属于行政法性质,虽然规定了集体经营性建设用地一级市场和集体经营性建设用地使用权二级市场等众多内容,但集体经营性建设用地一级市场和集体经营性建设用地使用权二级市场的运行更需要私法规制。针对集体经营性建设用地市场化运行之《土地管理法》规制不足剖析基础上,从"民法典物权编"如何与《土地管理法》衔接视角,提出集体经营性建设用地市场化运行之《民法典》私法规制立法完善对策,其研究目标为集体经营性建设用地市场化运行创造更好的法治环境。
The biggest highlight and major achievement of the newly revised Land Administration Law(which came into effect on January 1 of 2020)is the provisions on marketing rural collective land for development purposes.As an administrative law in nature,its provisions cover a wide range of contents on the primary market for the collective rural land for development purposes and the secondary market for the use rights of the collective rural land for development purposes.However,the operation of the two markets requires more private laws and regulations.Based on the analysis of the inadequacies of the Land Administration Law in its provisions on marketing rural collective land for development purposes,this paper puts forward some countermeasures to improve the legislation of the private laws and regulations in the Civil Code on marketing rural collective land for development purposes from the perspective of how to keep the Part on Property Rights of the Civil Code in consistency with the Land Administration Law,with the goal to create a better legal environment for marketing rural collective land for development purposes.
