论政府法治论视角下的社会治理方法与路径

On the Method and Path of Social Governance from the Perspective of Government Rule of Law

在“打造共建共治共享的社会治理格局”框架体系中,政府承担着“负责”的角色功能,是推动社会治理体系与治理能力现代化的主导力量。在全面依法治国进程中,社会治理必然在法治化轨道上循序推进,“政府法治论”为新时代社会治理提供了理论分析工具与价值支撑。在“政府法治论”的理论视角下,社会治理的价值目标是实现善治,而“依法律善治”则是其最佳的方法选择;社会治理的逻辑路径是实现政府法治化,坚持党的领导、推进法治政府建设与推动制度创新,分别是实现政府法治化的核心问题、实质问题与关键问题。

In the framework of“Building a Social Governance Pattern of Co-construction,Common Governance and Sharing”,the government is the leading force to promote the modernization of the social governance system and governance capabilities as it takes care of all.In the process of promoting rule of law,social governance will inevitably advance on the track of rule of law,with the“government constitutional theory”as theoretical analytical tool and value support for social governance in the new era.From the theoretical perspective of“government constitutional theory”,the value goal of social governance is to achieve good governance,and“good governance based on rule of law”is the best choice for it.The logical path of social governance is to realize the legalization of government,while the Party s leadership is the core,a government believing in rule of law is the essence and the system innovation is key in the process.
