环境正义视角下的国际环境法事先知情同意程序 被引量:1

On Prior Informed Consent Procedure of International Environmental Law from the Perspective of Environmental Justice

摘要 环境正义的核心内涵是环境权益与环境义务的公平分配。为了保护人类健康和环境免受危险物质及其越境转移可能造成的损害,事先知情同意程序促进各缔约方加强合作,分担和履行环境保护的共同义务。事先知情同意程序平衡交易双方的地位,倾向于保护弱势一方的权益,促使双方尽量在均势中达成公平的协议,这都彰显了环境正义。 The core connotation of environmental justice is the fair distribution of environmental rights and obligations.In order to protect human health and the environment from possible damage caused by dangerous substances and their transboundary movements,the Prior Informed Consent procedure promotes all contracting parties to enhance cooperation,share and fulfill their common obligations to protect the environment.At the same time,the Prior Informed Consent procedure balances the status of the two parties in the transaction,tends to protect the rights and interests of the weaker party,and encourages the two parties to reach a relatively fair agreement in the balance of power,which all demonstrates environmental justice.
