司法的社会功能及其实现

Social Function of Justice and Its Realization

作为现代国家治理体系的重要组成部分,司法治理的核心在于有效实现司法的社会功能。司法的社会功能是指法院借助其诉讼地位以及典型案例影响,化解社会纠纷并执行公共政策。受转型时期社会需求以及中国法治现代化模式影响,司法与其它社会治理方式交融混杂致使其社会功能被泛化和滥用,主要表现为:第一,将司法社会功能泛化理解为司法社会效果;第二,案外因素干预司法的方式更加隐蔽;第三,社会变革带来传统司法治理方式运行障碍,这也是影响司法治理效能的重大难题。针对此难题,解决对策主要有坚持司法社会功能“有限主义”,运用法律方法将公共政策融入裁判,结合智慧社会建设目标完善司法治理方式。

As an important component of the modern national governance system,the core of judicial governance lies in the effective realization of the social function of justice.The social function of justice refers to the court's ability to resolve social disputes and implement public policies through the use of its litigation status and the influence of typical cases.Influenced by the social demands of the transition period and the modernization model of the rule of law in China,the judiciary and other modes of social governance have been mixed and blended,resulting in the generalization and abuse of the social function of the judiciary,which is mainly manifested as follows:first,the social function of the judiciary has been generalized and understood as the social effects of the judiciary;second,extra-case factors interfere with the judiciary in a more subtle way;third,social change has brought about obstacles to the operation of the traditional mode of judicial governance,which is also a major challenge affecting the effectiveness of judicial governance.The main solutions to this problem include adhering to the“finite doctrine”of the social function of the judiciary,using legal methods to incorporate public policy into adjudication,and improving judicial governance in line with the goal of building a smart society.
