案卷功能视角下的基层法院审判机制--基于西部地区G省Z民族自治县的考察

Trial Mechanism of First-line Courts from the Perspective of Archives Function:Based on the Investigation of Z Ethnic Autonomous County in G Province in Western China

案件卷宗是司法活动契合立法文本的重要形式,从结构上表现出司法活动与国家法的一致,我国社会主义法律体系是法制化的文本和法治文本化的结合,通过运用案卷的司法活动,建构了国家法被实施的司法现象。但是在西部地区具有地方性民族色彩的基层法院,法治文本化进程产生了国家法实施空间的压缩现象。从案卷功能视角出发,观察G省Z民族县运用案卷的庭审活动,发现在个案中存在着运用国家法的文本现象和运用民间法的实际过程,基层法院案卷运用是国家法和民间法运行机制的结合。少数民族地区基层法院的县域环境,提供了国家法与民间法融合的空间,民间法介入国家制度运作具有必要性。同时应注意的是,由于我国是成文法国家,有必要对基层法院民间法介入国家制度运作进行一定的限制和考量。

Archive is an important form of judicial activities to conform to legislative texts,which shows the consistency of judicial activities and national laws in structure.China’s socialist legal sys⁃tem is a combination of legal texts and rules of law.Based on judicial activities which utilize ar⁃chives,the judicial phenomenon that national laws are implemented is constructed.However,in the first-line courts with local ethnic culture in the western region,the process of legalization has result⁃ed in the compression of the implementation space of national laws.From the perspective of archive function,the current paper investigates trial activities with using archives in Z ethnic county,G prov⁃ince,and finds that there is the textual phenomenon of using national laws and folk laws in individual cases,which is the combination of the operational mechanism of national law and folk law.The coun⁃ty environment of first-line courts in minority areas provides a space for the integration of national law and folk law,and it is necessary to integrate folk law into the national law.Meanwhile,it should be noted that,as China is a country with written law,it is necessary to limit and consider the involve⁃ment of folk law of first-line courts in the operation of the national system.
