The article adheres to the combination of theory and practice,and analyzes the provisions of The Judicial Interpretation of the Supreme People's Court on Some Issues Regarding the Application of Law in Trial of Mining Right Disputes,an in-depth analysis of mining and other contents is carried out,which focuses on the granting,transfer,lease and contracting,mortgage registration and cross-border of the mining right,,the outstanding problems and causes are pointed out,combined with the reform of the mining administration management system,the basic issues and legal relations such as the nature and connotation of mineral resources and mining rights are clarified,and puts forward some countermeasures and suggestions,such as strengthening the legislation of the resource industry,establishing and improving the mining sector's administrative legislation,law enforcement and judicial organs of communication and coordination mechanisms,etc.
