刑事检察业务指标考评的机制、问题与对策——以W市检察院为例

Mechanisms,Problems and Solutions of the Indicator Evaluation of Criminal Procuratorial Performance——Taking the W Municipal Procuratorate as an Example

“指标最优”可以说是相对合理主义场景下我国刑事检察业务考评的运作逻辑和现实选择。目前以检察机关整体为对象的考评模式占据主流,而检察官个人绩效考评被较少关注。通过对检察业务考评机制的历史演进以及运行状况等基本内容进行介绍,以W市基层检察院2019年度考评指标为样本,对考评指标的设置体系和计分方法进行梳理,可以发现以下几方面问题:一些指标过分追求有罪判决,不符合诉讼规律;一些新制度指标急于求成,偏离制度设计初衷;一些指标过于关注办案数量和效率,无法保障案件质量。应取消以有罪判决为导向的刚性指标,在保障办案质量的前提下考虑办案数量和效率,取消对认罪认罚适用率的硬性要求。

In the context of relative rationalism,“the optimization of indicators”is operational logic and practical choice of evaluation system of criminal procuratorial performance.At present,the evaluation of the procuratorate as a unit has been widely applied rather than appraisal of individual prosecutor.To start with,this article presents the basic mechanism,historical evolution,and operational situation of the evaluation system.And then,based on indicators from the W Municipal Procuratorate in 2019,both mechanism and scoring method of indicators are analyzed in this article.Certain indicators are susceptible of excessive pursuit of convictions,which does not comply with the fundamental laws of criminal procedure.Certain indicators regarding latest systems are too urgent to meet original ends.Certain indicators focus too much on amount and efficiency of disposition of the cases with less concerned with their quality.Therefore,the rigid indicators with the orientation of convictions shall be abolished.The amount and efficiency shall only be considered when the quality of case handling is assured.The high rate of application of guilt admission and punishment acceptance shall not be a mandatory requirement.
