论惩治犯罪与保障人权相结合的反恐刑事政策

On the Anti-terrorism Criminal Policy of Combining Punishment of Crime with Protection of Human Rights

惩罚犯罪与保障人权是现代刑法的两大功能,分别源于刑法的秩序维护机能和自由保障机能。科学地协调刑法的这两种机能和功能,是现代刑事法治的核心问题,影响着一个国家刑事法治的发展水平。当代各国反恐法治实践中普遍面临着过度克减人权保障的挑战。中国反恐法治中确立了“惩治犯罪与保障人权相结合”的刑事政策。反恐刑事法治中要有力地惩治犯罪自不待言,同时要从三个方面推动保障人权之政策精神的贯彻:一是要在反恐刑事法治中确立和弘扬人权保障的理念;二是应在反恐刑事立法中贯彻人权保障的精神;三是应当着重在反恐刑事司法中(包括刑法和刑事诉讼法实施方面)贯彻人权保障的精神。

Punishing crimes and safeguarding human rights are two functions of modern criminal law,which originate from the order maintenance function and freedom guarantee function of criminal law.Scientifically coordinating these two functions of criminal law is the core issue of modern criminal rule of law,which affects the development level of a country’s criminal rule of law.In the practice of anti-terrorism and rule of law in contemporary countries,they are generally faced with the challenge of excessively reducing the protection of human rights.In China’s anti-terrorism rule of law,the criminal policy of“combining punishment of crimes with protection of human rights”has been established.It goes without saying that crimes should be effectively punished in anti-terrorism criminal rule of law.At the same time,we should promote the implementation of the policy spirit of protecting human rights from three aspects:first,we should establish and carry forward the concept of human rights protection in anti-terrorism criminal law;second,we should implement the spirit of human rights protection in anti-terrorism criminal legislation;third,we should focus on implementing the spirit of human rights protection in anti-terrorism criminal justice(including the implementation of criminal law and criminal procedure law).
