摘要
对比文件是否给出了相反的技术教导时常成为发明申请创造性问题的争论焦点,本文以创造性判断过程中的三步法为出发点,从技术问题、技术手段、技术效果等不同的角度对几种常见的情形对相反的技术教导的判定方式进行简单总结,以期为类似案件的处理方式提供借鉴和参考。
Whether the cited relevant document gives the teaching away or not become the focus of discussion in the process of judging creativeness,this paper takes the three-step method of patent examination as a starting point,and summarizes the judgment method of teaching away from the perspective of technical problems,technical means and technical advantages,hopes to provide reference for dealing with similar work in the future.
