摘要
在创造性审查中,技术启示的判断一直是至关重要的一步,虽然"反向教导"这一术语未在《专利审查指南》中明确定义和举例,但其仍然对审查实践中创造性的判断产生了较大的影响。本文从"反向教导"的含义出发,结合实际案例,分析和梳理了创造性审查中常见的争辩反向教导的情形,并对是否存在反向教导进行辨析,以期为客观、准确认定技术启示,得出正确的创造性审查结论,提供一些参考和启发。
In the inventiveness examination of the patent application,the judgment of technical inspiration has always been a crucial step.Although the term"teaching away"does not appear in the Guidelines for Patent Examination directly,it still has a significant impact on the examination.In this paper,we combined the meaning of“teaching away”and the actual cases analyzed and sorted out the common situations of controversial about the"teaching away".And then analyzed whether there is"teaching away",in order to help to identify technical inspiration objectively and accurately,and then make right decision about inventiveness in examination and provide some reference and inspiration.
