区块链金融与法律监管刍议

Personal Opinions on Blockchain Finance and Its Legal Supervision

区块链金融是区块链管理、区块链技术在金融行业中的应用。区块链金融是混业经营与监管的需要、降低了金融价值交换成本、实现了智能化实时金融服务与金融监管。区块链金融强化了银行业务的“信任基础”,可实现业务数据的高度共享、有利于业务的跨界与拓展;能增强证券发行的透明度、提高交易、登记等环节的效率;可以防范保险欺诈、节约保险业务成本。我国区块链金融法律监管的主要问题在于监管理念滞后、法律制度不完善、监管手段落后。为此,更新监管理念,促进金融稳健;完善监管法律制度,风控防治并重;转变监管手段,推进依法监管是改进区块链金融法律监管的可行路径。

Blockchain finance is the application of blockchain management and blockchain technology in the financial industry.It is the need of mixed operation and supervision,reducing the cost of financial value exchange and realizing intelligent real-time financial services and financial supervision.It strengthens the"trust basis"of banking business,helps achieve a high degree of business data sharing and is conducive to the cross-border and expansion of business,while enhancing the transparency of securities issuance,improving the efficiency of transactions,registration and other conversions,apart from preventing insurance fraud and saving the cost of insurance business.The main problems in China′s legal supervision of blockchain finance are the lagging of supervision concept,imperfect legal system and backward regulatory means.Therefore,the improvement paths lie in updating the supervision concept and promoting financial stability,improving the supervision legal system and paying equal attention to risk control and prevention,and changing supervision means and developing legal supervision.
