实证研究发现,应诉管辖规则的适用存在以下问题:忽视被告的应诉答辩、错误认定应诉答辩、机械适用应诉管辖规则、忽视共同被告的意愿等。应防止被告滥用管辖异议权、法院的部门本位主义和地方保护主义,保护当事人的管辖异议权。

An empirical study finds that there are some problems in the application of jurisdiction in response to litigation:ignoring the respondent s reply,mistaking the respondent s reply,mechanically applying the rule of responding jurisdiction,ignoring the will of the co defendants,etc.We should prevent the defendant from abusing the jurisdiction objection right,the departmental departmentalism and the local protectionism of the court,and protect the parties jurisdiction objection right.
