洞庭湖流域保护的立法问题研究

On the Legislation of Dongting Lake Basin Protection

随着长江经济带和洞庭湖生态经济区国家战略的实施,洞庭湖流域保护的立法问题更加凸显。现行的洞庭湖流域保护立法存在水事法规体系结构性缺陷,水生态和水污染防治的法律制度不健全,立法统筹性不足等问题。在洞庭湖流域保护立法中,我们应依据可持续发展,优先保护、预防为主,统筹兼顾、协调发展等原则,对洞庭湖流域开发与利用环境影响评价制度、洞庭湖流域保护综合管理制度、生态环境监测预警和监察制度、洞庭湖流域水资源开发许可证制度、洞庭湖水污染防治制度、洞庭湖流域湿地生态自然保护区制度、洞庭湖流域生态补偿制度和洞庭湖流域保护中的公众参与等制度进行建构或完善,为洞庭湖流域综合治理及生态环境保护提供有益参考。

With the implementation of the national strategy of Yangtze River Economic Belt and Dongting Lake Ecological Economic Zone,the legislative issues of Dongting Lake Basin protection are becoming more prominent.However,there are some problems in the protection legislation of Dongting Lake Basin,such as the structural defects of water laws and regulations system,insufficient legislative coordination,and imperfect legal system of water ecology and water pollution prevention and control.Therefore,it is necessary to carry out such prevention and control systems as environmental impact assessment system,Dongting Lake protection and management system,ecological environment monitoring and early warning and supervision system,water resources development permit system,water pollution control system of Dongting Lake and wetland ecology.It is expected to provide a useful reference for the comprehensive management and ecological environment protection of Dongting Lake Basin.
