论政务处分制度对传统政纪处分制度的扬弃与超越

Sublation and Transcendence of Administrative Sanction System and Administrative Disciplinary System

推进国家监察体制改革,改“纪”为“法”,传统政纪处分制度由此嬗变为新的政务处分制度。新的政务处分制度不但增强了外部化、法律化,还在制度要素上表现得更加清晰,日益摆脱处分依据模糊不清、处分主体到底是谁、处分对象宽窄不一的争论,走上健康发展之路。随着党和国家监督体系的进一步健全完善,政务处分制度在与党纪处分制度相匹配的同时,越发凸显出规制职务违法的独立制度价值。

Pushing forward the reform of national supervision system to change“discipline”into“law”,administrative disciplinary system evolution for administrative sanction system,not only enhances its external nature and legalization,but also defines the system elements more clearly,free from the controversy about basis for punishment,disciplinary subject and disciplinary object progressively,on the road towards the healthy development of system.With the further improvement of the supervision system of the party and the state,administrative sanction system matches the system of party discipline punishment,which meantime highlights the independent system value of regulating the violation of duties.
