论“儿童利益最大化”在家事立法与司法中之贯彻与完善

On the Implementation and Perfection of“Maximization of Children’s Interests”in Family Legislation and Judicature

“儿童利益最大化”已成为我国家事立法、司法发展的必然趋势。但该原则在我国目前处于起步阶段,对抚养费、探望权、儿童参与权等方面的法律规定并没有充分体现“儿童利益最大化”原则,加上对儿童心理疏导非规范化和父母轻率离婚造成子女身心伤害等问题,导致在家事纠纷中难以贯彻“儿童利益最大化”原则。要在家事纠纷中真正实现“儿童利益最大化”,我国立法应当调整抚养费的标准、赋予儿童主动交往权以弥补探望权规定的缺憾、提高儿童参与度、心理疏导规范化以及配套规定离婚冷静期和亲职教育以减少对子女的伤害,促进我国在处理婚姻家事纠纷中能够全面、准确地体现保护未成年子女利益的立场。

“Maximizing children’s interests”has become an inevitable trend in the development of our national affairs legislation and justice.However,this principle is currently in its infancy in my country.The legal provisions on support,visitation rights,and children’s participation rights do not fully reflect the principle of“maximizing children’s interests”.In addition,the non-standardization of children’s psychological counseling and parental divorce caused Problems such as the physical and psychological harm of children make it difficult to implement the principle of“maximizing children’s interests”in family disputes.To realize the real realization of“maximization of children’s interests”in family disputes,my country’s legislation should adjust the standards of support payments,grant children the right to proactively communicate to make up for the shortcomings of visitation rights,improve children’s participation,standardize psychological counseling,and provide supporting divorce cooling-off periods and relatives.Vocational education can reduce the harm to children and promote our country to fully and accurately reflect the position of protecting the interests of minor children in handling marriage and family disputes.
