文化多元化背景下监狱安全治理的进路

The Approach of Prison Security Management under the Background of Cultural Diversity

在多元化的文化视域中,监狱的安全首先应该是文化的安全,监狱的安全治理必须置于总体国家安全观框架内的社会综合治理体系之中统筹规划,梳理出一条规范化的文化治理路径。从价值认同的视角审视监狱的文化安全和文化生态,是现代监狱制度的法治内涵;传统与现代治监理念的碰撞与整合,是监狱安全刚性维稳与柔性治理并重的理性抉择;罪犯自我归属感和自我安全感的价值认同是监狱安全治理的人文内涵;发挥文化的塑造功能、治理功能和改造功能,是文化改造的应有之义,也是监狱安全治理的理性需求。所以,文化多元化背景下监狱安全治理的进路理应是通过文化安全、文化治理和文化改造,最终形成具有法治文化内涵的、有中国监狱特色的安全治理理念和治理对策。

In the pluralistic cultural vision,the safety of prison is first of all the safety of culture.The security governance of prison must be placed in the comprehensive social governance system within the framework of the overall national security concept,so as to sort out a standardized path of cultural governance.To examine the cultural security and cultural ecology of prisons from the perspective of value identification is the legal connotation of modern prison system;the collision and integration of traditional and modern governance and supervision concepts is a rational choice of paying equal attention to both rigid and flexible prison security;the value identification of prisoners’sense of belonging and self security is the humanistic connotation of prison security governance;it is not only the proper meaning of cultural transformation,but also the rational demand of prison safety management to give full play to the shaping function,governance function and transformation function of culture.Therefore,under the background of cultural diversity,the approach of prison security governance should be through cultural security,cultural governance and cultural transformation,and finally form a security governance concept and countermeasures with legal culture connotation and Chinese prison characteristics.
