民事执行检察监督制度的完善

民事执行是权利人实现正当权益的最后一道关卡,为破解"执行难""执行乱"的问题,将其纳入检察监督的体系中最为合适。我国民事执行检察监督制度应从以下三个方面予以完善:首先,须从权力设置及运行过程方面入手,确立遵守有限、合法监督的原则;公正、效率监督的原则;优先事后监督、被动监督的原则。其次,明确监督对象、监督范围和监督方式。最后,强化民事行政检察部门的专业人员配备和专业性人才建设。

Civil execution is the last level for the obligee to realize the legitimate rights and interests.In order to solve the problem of"execution difficulty"and"execution disorder",it is most appropriate to bring it into the system of procuratorial supervision.The procuratorial supervision system of civil execution in our country should be perfected from the following three aspects:first,it is necessary to establish the principle of observing limited and legal supervision from the aspects of power setting and operation process;the principle of fair and efficient supervision;and the principle of giving priority to post-supervision and passive supervision.Secondly,clear supervision object,supervision scope and supervision mode.Finally,strengthen the civil administrative procuratorial department professional staffing and professional personnel construction.
