论新时代体育强国建设背景下的中国体育法研究

Chinese Sports Law Study Under the Background of Building a Sports Power in the New Era

信息化、大数据、全球化时代和中国特色社会主义法治体系建设的全面推进以及中国体育国际地位的不断提升对中国体育法研究产生了深远影响。新时代体育强国建设对中国体育法研究产生了新需求,我国学者应尽快通过深掘基础理论、遵循问题导向、重视比较研究、践行实证考察等进路来创新中国体育法理论与制度,重点研究北京2022年冬奥会筹办与主办期间重要法律问题的前瞻对策、新时代青少年体育发展的法治保障、《中华人民共和国体育法》及相关配套法规的优化与完善、海外体育法的前沿动向与新发展、增强国际体育法律规则发展的中国话语权等课题,以构建具有中国特色、中国风格、中国气派的并且能够深度融入世界学术话语体系的中国体育法学。

Informatization,big data,globalization era,the comprehensive promotion of the construction of socialist rule of law system with Chinese characteristics and the continuous improvement of China’s sports international status have had a profound impact on Chinese sports law study.The construction of a sports power in the new era has brought about new demands for Chinese sports law study.Chinese scholars should,as soon as possible,innovate the theory and system of Chinese sports law by digging deep into the basic theory,following the problem orientation,attaching importance to comparative research,and practicing empirical investigation.Meanwhile,Chinese scholars should also focus on the forward-looking countermeasures of important legal issues during the preparation and hosting of the 2022 Winter Olympic Games in Beijing,the legal guarantee for the development of youth sports in the new era,the optimization and improvement of the Sports Law of the People’s Republic of China and related supporting laws and regulations,the frontier trend and new development of overseas sports law,and the enhancement of China’s discourse power in the development of international sports laws and regulations,so as to build a Chinese sports law with Chinese characteristics,Chinese style,Chinese manner and can be deeply integrated into the world academic discourse system.
