摘要
美国作为“雇佣作品原则”的起源国,其关于雇佣作品原则的立法及司法实践内容丰富,对我国具有较高的借鉴价值。通过对有关“雇佣作品原则”主要法条的分析,可以看出,美国的版权立法深受本土文化的影响,凸显了对经济利益的追求。美国关于“雇佣作品原则”的立法规定更是与其社会政治经济制度密切相关的,并且在司法实践中逐步得到完善。美国虽然创建了“雇佣作品原则”,但其规定并非画一之法,我国在具体适用该原则时,仍需结合本国国情,实现该原则的本土化改造。申言之,我国不必拘泥于所谓的法系派别,而应当从善如流,择优而用,在立法中明确接纳“雇佣作品原则”,并以指导案例的形式,确定职务作品的认定标准。
As the country where the“Work-for-Hire Doctrine”originated,the United States has abundant legislation and judicial practice on this doctrine,which is of great reference value to China.The articles about“Work-for-Hire Doctrine”in American law show that the copyright legislation of the United States is deeply infl uenced by its culture,highlighting the pursuit of economic interests.The American legislation on the Work-for-Hire Doctrine is closely related to its political and economic system and gradually improved in judicial practice.However,when this doctrine is applied in China,it is essential to co nsider the actual situation of China and realize the localization of this doctrin e.In other words,China does not have to stick to the so-called genealogy of law,but choose the most appropriate way to follow.The“Work-for-Hire Doctrine”should be explicitly adopted in the form of Guiding Cases to determine the identifi cation criteria of works for duty.
