长三角区域知识产权执法协作的困境及对策研究

Research on the Dilemma and Countermeasures of Intellectual Property Rights Enforcement Cooperation in the Yangtze River Delta

长三角知识产权保护一体化发展建立在协同高效的执法协作基础之上。当前,长三角知识产权执法协作的制度建设初具雏形,形成了以联席会议为纽带、由工作协调小组牵头运行的协同运行机制,协同保护成效明显。但是,仍面临区域性立法滞后、执法联动协调机制不够顺畅、案件的法律适用标准和判罚尺度不统一以及信息共享平台建设薄弱等困境和问题。为此,需要加快推进长三角区域的知识产权保护协同立法进程,逐步融通跨区域、跨部门执法协作的运行机制,尽快制定知识产权案件自由裁量基准,加强知识产权执法协作大数据信息监管平台建设等。未来,在大数据、云计算、人工智能等“互联网+”技术手段的支撑下,区域知识产权信息将汇聚成一张庞大的数据网络,驱动知识产权保护理念创新、流程再造和能级提升。

The integrated development of intellectual property rights protection in the Yangtze River Delta is based on coordinated and efficient law enforcement cooperation.At present,the system construction of intellectual property enforcement cooperation in the Yangtze River Delta has taken shape,forming a collaborative operation mechanism that takes the joint meeting as the link and is led by the work coordination group,and the collaborative protection has achieved remarkable results.However,it still faces many difficulties and problems such as lagging regional legislation,insufficient coordination mechanism of law enforcement,inconsistent standards of legal application and punishment standards for cases,and weak construction of information sharing platform.To this end,it is necessary to accelerate the process of coordinated legislation on intellectual property protection in the Yangtze River Delta region,gradually integrate the operation mechanism of cross-regional and cross-sector law enforcement cooperation,formulate discretionary benchmarks for intellectual property cases as soon as possible,and strengthen the construction of a big data information supervision platform for intellectual property enforcement cooperation.In the future,with the support of“Internet plus”technologies such as big data,cloud computing and artificial intelligence,regional intellectual property rights information will converge into a huge data network,driving the innovation of intellectual property protection concepts,process reengineering and level improvement.
