Research Progress and Improvement Strategy of the Right for the Visually Impaired to Acquire Film and Television Works

视障者影视作品获取权是残疾人阅读权的重要组成部分。无障碍电影是专为视障者制作发行的影视作品,涉及原版电影版权人的复制权、发行权、改编权、表演权和网络信息传播权等权利。我国版权法的无障碍条款仅仅规定盲文为无障碍合理使用范围,不利于保护我国残疾人的整体福利,应增加影视作品,同时将"盲文版"的表述改为"无障碍格式版"。无障碍电影的发行主体应为经授权的公益组织,无障碍通过技术手段等保障为残疾人所专用。在无障碍电影的制作成规模后,应考虑向原版电影版权人支付低于商业许可费的合理费用。

The right to acquire film and television works is an important part of the reading right of persons with disabilities.The barrier-free film is produced and distributed for the visually impaired persons,involving the copy rights of the original film,such as the right to copy,distribute,adapt,perform and transmit network information.The barrier-free clause of China’ s copyright law only stipulates that Braille is barrier free,which is not completely conducive to the protection of the overall welfare of persons with disabilities in China.Therefore,we should increase film works,and change the expression of "Braille version" to "barrier free format version".The distribution subject of barrier free films shall be authorized public welfare organizations,and shall be exclusively used by persons with disabilities through technical means.After the scale of the barrier free films,reasonable fees lower than the commercial license fee should be considered to be paid to the original film obligee.
