“医闹”型犯罪的成因与防治探析——基于对80例“医闹”刑事案件的实证考察

Analysis on the Causes and Prevention of“Medical Disturbance”Crimes——Based on the Empirical study of Eighty Cases of“Medical Disturbance”Criminal Cases

近年来杀医、伤医、辱医案件时常发生,杨文医生被害案件更引起社会广泛的关注。文章主要采用犯罪学实证研究方法,从中国裁判文书网上选取了近十年的80例“医闹”刑事案件,在对此类犯罪现象的相关要素进行类型化分析的基础上,旨在探究“医患纠纷”矛盾的源头,并提出有针对性的预防与治理措施。

In recent years,the cases of killing,injuring and insulting doctors have occurred frequently,and the murder of Dr Yang Wen has aroused widespread public concern.This paper employed empirical method.It selected eighty criminal cases of“medical trouble”from the online Chinese Judicial Documents in the past ten years.Based on the type analysis of the relevant elements of such criminal phenomena,it meant to explore the cause of the“Doctor-patient disputes”contradiction,and proposed prevention and treatment measures.
