开放获取版权保护模式中国化探析

An Analysis of the Chinese Mode of Copyright Protection of Open Access

开放获取是科学界、学术界等为了实现科研成果的交流与共享,实现科研成果社会价值最大化、利用新兴网络传播技术进行学术广泛传播和交流而兴起的运动,它体现了面对新兴传播方式的出现,现有版权制度无法有效调节社会公众与作品权利人之间的利益关系,而开放获取版权保护模式可以有效地解决这个问题,该模式也被越来越多的国家或地区所认可和采用。随着开放获取运动在我国蓬勃发展,我国的法律法规、政策等也为我国构建开放获取版权保护模式奠定了良好的基础,使该版权保护模式在我国实施成为可能。

Open Access is an emerging movement which takes advantage of new network communication technology to realize the communication and sharing of scientific research achievements and maximize the social value of them in scientific,academical community and other communities.Facing the emergence of new communication ways,Open Access reflects the existing system of copyright protection can’t effectively regulate the interest relationship between the public and the right holders of works,while the copyright protection mode of Open Access can effectively solve this problem and it’s accepted and adopted by more and more countries or regions.With the vigorous development of the Open Access movement in China,the laws,regulations and policies of our country also lay a good foundation for establishing the copyright protection model of Open Access,and make it possible to implement the copyright protection model in our country.
