Study on local legislation of the Yellow River protection

我国黄河河道保护的专门立法与一般立法明显不足。现有黄河河道保护立法,在立法宗旨、管理体制、河道整治与建设、具体河道保护制度设计及法律责任制度设定方面存在一定欠缺,主要原因为立法理念滞后、立法程序不到位、部门影响及立法不严谨。制定、完善黄河河道保护地方性法规、规章可采取先地方、后中央的路径;在设计黄河河道保护制度时既要确立河道功能保护和生态环境保护立法宗旨,又要明确“一元主导、多元配合”管理体制;既要科学设计具体的河道保护制度,又要平衡设计行政主体及行政相对方的法律责任制度。

The special and general legislation of Yellow River Protection in China is insufficient.The existing legislation on the protection of the Yellow River channel has some deficiencies in terms of legislative purpose,management system,river regulation and construction,specific river protection system design and legal liability system.The main reasons for the above problems are the lack of legislative initiative,the lag of legislative idea,the lack of legislative procedure,the influence of"legislation"and the lack of legislative attitude.In formulating and perfecting the Local ordinance and regulations for the protection of the Yellow River Channel,we should adopt the mode of first local and then central,and not only avoid the legislation of"departments",but also insist on open-door legislation and respect the law and science In the specific design of the Yellow River Protection System,we should not only establish the legislative purpose of the river function protection and the ecological environment protection,but also define the management system of"single leading,multi-cooperation";We should design not only the specific river protection system scientifically,but also the legal responsibility system of the administrative subject and the opposite party in balance.
