The Bio-Security Law in the Context of Ecological Progress:Concept and System

生物安全问题发生于从工业文明发展到生态文明的过程之中,其出现并被人类认知和关注。生物安全立法的推进与加强生态文明建设的宏观背景息息相关。生物安全法治应遵循生态整体主义伦理观和以风险预防原则为中心、以谨慎发展原则和全程管理原则为支撑的法律原则,形成以维护生态安全、保护人体健康、促进现代生物技术健康发展以及保障国家安全为主要内容的多元协调的目标体系。在法律制度建设层面,应重点推进形成多部门协同的管理体制,形成精细化的风险防范机制和基于科学标准的安全审查机制,同时重视面向公众的生物安全风险沟通。

The emergence of the bio-security problem and people’s understanding of and concern about it have all occurred while the industrial civilization transitioned toward the era of ecological progress.The furthering of the bio-security legislation is closely related to the macro background of ecological progress.The bio-security rule of law should follow the ethics of ecological holism and the legal principles of focusing on risk prevention and relying on prudent development and whole-process management,so as to form a multi-level and coordinated target system with the main contents of maintaining ecological security,protecting human health,promoting the healthy development of modern bio-technology,and ensuring national security.At the level of legal institutional improvement,we should focus on creating a multi-department collaborative management system,establish a refined risk prevention mechanism and a security review mechanism based on scientific standards,and also pay attention to communicating with the public over bio-security risks.
