总体国家安全观下的生物安全刑法治理

Criminal Law Governance of Bio-Security from the Perspective of Overall National Security

生物安全是总体国家安全的重要组成部分。加强国家生物安全能力建设,切实提升国家生物安全治理体系与治理能力,是当前与今后我国国家安全建设的重要维度。加强生物安全治理体系与治理能力建设,有必要在该领域配置刑事责任。刑事责任的配置既需考量刑事法治的统一性与生物安全治理的特殊性,又需考量国家生物安全的多元治理与刑事责任配置的关系。生物安全领域刑法功能的实现既需在该领域进行科学的刑事立法,充分发挥刑法的惩治与预防机能;也需充分挖掘公民、法人、行政机关、社会组织的多元共治机能,并应积极参与和建设基于人类命运共同体理念的全球生物安全治理体系。

Bio-security is an important part of national security.Strengthening bio-security capacity building and effectively improving the governance system and capacity for bio-security are the important dimensions of China’s national security protection at present and in the future.It is necessary to allocate criminal responsibilities in this area so as to perfect China’s system of governance and governance capacity for bio-security.In allocation of criminal responsibilities,we should not only consider its conformity with the rule of law and the particularity of bio-security governance,but also examine the relationship between the diversified governance of national bio-security and the allocation of criminal responsibilities.The realization of the function of criminal law in the field of bio-security not only requires enacting scientific criminal legislation and letting the criminal law play its role in punishing and preventing crimes,but also entails exploring the mechanism for diversified co-governance by citizens,legal entities,administrative organs and social organizations and actively participating in creating the global bio-security governance system based on the concept of human community with a shared destiny.
