我国行政权监督研究述评

Review on Supervision of Administrative Power in Our Country

20世纪90年代以来,我国学术界在行政权监督的必要性认识、监督类型划分、存在问题分析,以及监督效果优化等方面进行了诸多研究,并取得了一批有价值的研究成果,但整体上看研究视野还不够开阔,深度也不足。具体而言,对监督主体的研究存在失衡问题;缺乏非常态下行政权的监督研究;在行政权监督研究上存在两大研究倾向,重静态轻动态研究,重形式轻效果研究;对国外行政监督经验介绍、借鉴不足。

Since the 1990s,the academic circles in our country have obtained a batch of valuable research results by carrying out a lot of studies on supervision of administrative power from many aspects,such as the recognition of its necessity,the division of supervision types,the analysis of existing problems and the optimization of supervision effects;however,there is neither broad research horizon nor enough research depth on the whole.Specifically,the following problems still exist in the studies on supervision of administrative power:there is an imbalance in the study of the subject and lack of relevant studies in the abnormal state;there are two research tendencies:giving emphasis on static system while neglecting dynamic process and giving fucus on form while trifling with effect research;there is insufficient introduction and reference from the experience of foreign administrative supervision.
