构建民办教育失信惩戒制度的基本逻辑、现实可能与主要路径

建立有效的失信惩戒制度,是提升民办教育公信力和竞争力,改善其信誉度和美誉度的关键。失信惩戒制度的重要价值在于其具有引导性、威慑性和惩罚性。在民办教育新法新政实施背景下,以国家层面建立民办教育失信惩戒制度的原则性规定为指引,借鉴国内其他行业领域及国外失信惩戒制度的经验,构建民办教育失信惩戒制度具有充分的可行性。新时期,应以新修订的《民办教育促进法》及其配套政策正式实施为契机,加快构建民办教育失信惩戒制度,建立涵盖信用惩戒对象、信用惩戒措施、惩戒实施方式和失信惩戒管理等重要内容的民办教育失信惩戒制度体系,引导和鼓励全社会力量对民办学校失信行为进行有效的监督并依法对失信行为作出惩戒。

Establishing an effective penalty system for dishonesty is the key for enhancing the credibility and competitiveness of non-governmental education and improving its credibility and reputation.The important value of the penalty system for dishonesty lies in its guiding,deterrent and punitive nature.Under the background of the implementation of the new law and new policy on non-governmental education,guided by the state's principled regulations for establishing a penalty system for dishonesty in nongovernmental education and drawing on the experience of other domestic industries and foreign dishonesty penalty systems,it is feasible to construct a penalty system for dishonesty in non-governmental education.In the new era,the formal implementation of the new Non-governmental Education Promotion Law and its supporting policies should be taken as an opportunity to speed up the construction of a penalty system for dishonesty in non-governmental education,covering dishonesty punishment targets,punishment measures,punishment methods,and punishment management.This is to guide and encourage the whole society to effectively supervise the behaviors of non-governmental schools,and punish for their dishonesty.
