长三角一体化城管执法的制度基础与实践探索

Urban Management and Law Enforcement Cooperation in Yangtze River Delta Region:Institutional Basis,Practical Exploration and Thinking

为推动长三角区域一体化发展,江苏、浙江、安徽、上海"三省一市"城管执法部门对执法协作进行积极探索。长三角区域城管执法协作的宏观制度基础提供可资借鉴的理念和思路,但执法协作的微观制度基础比较薄弱。目前,长三角区域城管执法协作经历了区县层面合作、设区的市层面合作、省级层面合作三个阶段,为未来执法协作的深入开展奠定良好基础。由于城管执法协作是长三角区域一体化发展中的一项全新工作,有必要未雨绸缪,对跨区域执法的执法权限、执法协作的执法范围、执法协作的法律适用、执法协作的数据共享等有关问题进行前瞻性的思考。

In order to promote the regional integration of the Yangtze River Delta,the Urban Management and Law Enforcement Departments of Shanghai,Jiangsu,Zhejiang and Anhui have actively explored law enforcement cooperation.The macro institutional basis of urban management and law enforcement cooperation in Yangtze River Delta region provides some ideas and thoughts for reference,but the micro institutional basis of law enforcement cooperation is relatively weak.At present,the Yangtze River Delta urban management and law enforcement cooperation has experienced three stages:county level cooperation,city divided into districts level cooperation and provincial level cooperation,which has laid a good foundation for the further development of law enforcement cooperation in the future.As the urban management and law enforcement cooperation is new work in the Yangtze River Delta regional integration,it is necessary to take precautions and make forward-looking thinking on such issues as the law enforcement authority limits of cross-region law enforcement,the law enforcement scope of law enforcement cooperation,the legal application of law enforcement cooperation,and the data sharing of law enforcement cooperation.
