Research on the Improvement of China’s Legal System for Energy in Response to Climate Change

气候变化问题的应对不可能绕开能源问题。文章着眼于气候变化与能源发展之间的相互关系,立足于应对能源立法现状和发展趋势,从当前我国能源领域的实践出发,研究完善以正在审议的能源法为中心,以节约能源法、可再生能源法等内部制度为补充,以环境保护法、自然资源法、循环经济法等外部制度为衔接的,适合基本国情和发展需要的应对气候变化能源法律制度。

The response to climate change cannot bypass the energy problem.This paper focuses on the relationship between climate change and energy development,based on the current situation and development trend of energy legislation.Based on the practice of energy field in China,the paper studies the energy law under consideration,complements the internal systems such as energy conservation law and renewable energy law,and takes the external systems such as environmental protection law,natural resources law,circular economy law as the complement.It is argued that these make suitable energy legal system that are able to cope with climate change and fit China’s situation.
