对我国“网店转让第一案”的法律评价与反思——以网店的虚拟财产属性为视角

Legal Evaluation and Reflection on “The First Case of Online Shop Transfer” in China: From the Perspective of the Virtual Property Attributes of the Shop

"王兵网店转让案"作为最高人民法院发布的第一批涉互联网典型案例,其必将对未来的司法实务起到重要的指导作用。但就该案件的裁判要旨和论证思路来看,其罔顾了网络店铺的实质构成和网店转让的客观对象,因此导致了对网络店铺法律性质的误判。网络店铺作为网店经营信誉、经营时间、访问人数、收藏人数、网店好评率的有机结合体,其极大地契合了洛克在"劳动财产理论"中对财产实质内涵的论断,是现代电子商务经济催生的一种新的财产类型。网络店铺具有虚拟性、独立性、价值性、合法性特征,属于典型的网络虚拟财产,对网络店铺转让的法律规制必须以该法律定性为根本起点和依据。

As the first batch of Internet related typical cases issued by the Supreme People’s court,"Wang Bing online shop transfer case"will certainly play an important guiding role in the future judicial practice. However,judging from the ruling gist and argumentation of the case,it ignored the substantial composition of the online stores and the objective object of the online shop transfer,which leads to a wrong judgment of the legal nature of the online shop. As an organic combination of business reputation,operation time,number of visitors,number of collectors,and praise rate of online stores,online stores greatly agree with Locke’s judgment on the essence of property in"labor property theory",and it is a new type of property promoted by modern e-commerce economy. The online shop has the characteristics of virtuality,independence,value and legitimacy,which is a typical network virtual property. The legal regulation of online shop transfer must take the legal nature as the basic starting point and basis.
