区域协调发展的经济法治新维度——定位重塑与体系演进

A New Dimension of Economic Rule of Law in Regional Coordinated Development——Position Remodeling and System Evolution

以2012年步入新常态为标志性时点,保障区域协调发展的经济法治体系在整体的宏观调控法治系统中扮演了愈加重要的角色,并借此实现了"定位重塑"。与此同时,区域协调发展的经济法治未来发展路向呈现出"体系演进"中的继承与创新。这种体系演进的道德性基础在于寻求化解区域发展中的"不平衡、不充分"问题,其规范性基础在于实施宪法框架下的区域发展治理机制,进而构建硬法与软法合力共治的区域经济法治模式。展望迈向"十四五"的区域经济法治,有待解决"问题引领""价值协调"和"规范协同"三个方面的重要问题,由此增益区域协调发展中的良法与善治。

Taking the year 2012 as the landmark point of entering the new normal,the system of economic rule of law which guarantees the coordinated development of the region has played an increasingly important role in the overall macro-control legal system,and has realized positioning remodeling. At the same time,the future development direction of economic rule of law of regional coordinated development has presented inheritance and innovation in system evolution. The moral basis of the evolution of this system lies in seeking to resolve the problem of imbalance and inadequacy in regional development,and its normative basis lies in the implementation of the governance mechanism of regional development under the framework of the constitution,and then constructs the regional economic rule of law mode of joint governance of hard law and soft law. Looking forward to the rule of law of regional economy in the 14 th five year plan,there are three important problems to be solved,which are the"problem leading","value coordination"and"standard coordination",so as to enhance the good law and good governance in regional coordinated development.
