后疫情时代劳动关系二元结构的局限与反思——基于社会法实质正义理念视角 被引量:1

摘要 新冠肺炎疫情的不确定性和危害性给我国社会稳定发展带来了挑战。在后疫情时代,劳动关系二元结构存在诸多局限,具体表现为责任划分不平衡、非典型劳动关系发展与劳动法律规制不协调、二元结构下社会保障制度设计不充分等。劳动关系二元结构局限造成了行业经济差异性与劳动法调整单一性、市场形态多元性与劳动法律制度滞后性、制度保障缺陷性与社会法公平性之间的矛盾。重塑劳动关系需要使劳动法律制度与“众创”式制度变革相适应,逐步缩小劳动关系二元结构中社会保障制度差距,实现行业内部自律和法律外部规制相互配合。 The uncertainty and danger of the new coronary pneumonia epidemic poses a challenge to the stable development of China's society.There are many limitations in the dual structure of labor relations in the postepidemic era,specifically the unbalanced division of responsibilities,the uncoordinated development of atypical labor relations and labor law regulation,and the inadequate design of the social security system under the dual structure.To reshape labor relations,it’s necessary to adapt the labor law system to the"mass creation"system change,gradually narrow the gap between the social security system in the dual structure of labor relations,and realize the coordination between the internal self-discipline of the industry and the external regulation of the law.
