我国完善农村纠纷调解机制分析

调解作为解决纠纷的重要环节是维护社会稳定发展的有效机制,农业、农村和农民问题是关系国计民生的根本性问题,合理解决农村纠纷矛盾是中国广大农村可持续发展的关键因素。因此,进一步完善农村纠纷调解机制,维护农村和谐稳定发展至关重要。现阶段农村地区主要存在人民调解、行政调解和司法调解三种调解机制。然而,在人民调解机制下,存在人民调解员专业素质欠缺、大多依据民间习惯调解或大量签订口头调解协议等现实问题,使得农业、农村和农民问题方面的人民调解的信任度降低。此外,在农村行政调解机制、基层司法调解机制中,仍然存在调解人员、法官专业素质较低等实际问题,尚需完善。因此,加强农村人民调解队伍建设、提升人民调解员专业素养势在必行,而乡镇行政机关、基层司法机关有效调整内部相关程序规定亦是完善农村纠纷调解机制的关键因素之一。

Mediation,as an important link to resolve disputes,is an effective mechanism for maintaining stable social development.The issues of agriculture,rural areas,and farmers are fundamental issues related to national economy and people's livelihood.Reasonably resolving rural disputes and contradictions is a key factor for the sustainable development of China's vast rural areas.Therefore,it is essential to further improve the rural dispute mediation mechanism and maintain the harmonious and stable development of the rural areas.At present,there are three mediation mechanisms in rural areas:people's mediation,administrative mediation and judicial mediation.However,under the people's mediation mechanism,there are practical problems such as the lack of professional qualities of the people's mediators,mostly based on folk customary mediation or excessive oral mediation agreements,which reduces the trust of people's mediation in agriculture,rural areas and farmers'issues.In addition,in the rural administrative mediation mechanism and the grassroots judicial mediation mechanism,there are still practical problems such as low professional quality of mediators and judges,which need to be improved.Therefore,it is imperative to strengthen the construction of the rural people's mediation team and improve the professional qualities of the people's mediators.The effective adjustment of the internal related procedures of the township administrative organs and grassroots judicial organs is also one of the key factors to improve the rural dispute mediation mechanism.
