社科翻译中弱式非本质主义立场之提倡——以法学界对privacy的翻译为例

Weak-form Anti-essentialism Should Be Advocated in Social Translation--Taking the Translation of“Privacy”as an Example

Privacy是美国法的一个重要概念,我国法学界一般译为"隐私"或"隐私权",这是由于采取本质主义的立场而产生的误译。弱式非本质主义应成为社科翻译的指导,这既是对母语、译语特定的历史和社会文化背景的选择性适应,也是社科翻译中"意义"再造的要求。受弱式非本质主义的影响,译者应该坚持"可译性"立场,在"意义"再造上采纳异化翻译策略,注意利用补充式注释进行"意义"补偿。

Privacy is an important notion in American law.However,on the basis of essentialism,it has been mistranslated into"Yinsi"or"Yinsiquan"by the Chinese jurisprudential circle.In order to adapt to the target cultural background and recreate mea-ning,weak-form anti-essentialism should be advocated in the translating process of social texts.Based on this,translators are expected to adhere to the standpoint of translatability and adapt strategies of foreignization and annotation to reach the ultimate aim of translation.
