环境法典的制度体系逻辑与表达

Logic and Expression of System of Environmental Code

环境法对于制度进一步体系化存在迫切需求,法典化的讨论业已由必要性探讨转向可行性探究,目前处于环境法典制度体系建构的理论探讨恰当时机。应以环境法典制度体系希冀达成的理想图景与运转样态为出发点,探究建构期许向建构逻辑与建构表达的两次转化:一是将建构期许具象化为"适度"体系化与"适度"开放性的建构原则、制度确定与制度编排的内在逻辑;二是将建构期许与逻辑现实化为环境法典制度体系中内容的划定、总体框架结构的设计与篇章脉络的确定。

There is an urgent need for the further systematization of environmental law.The discussion of codification has shifted from necessity to feasibility,so it is an appropriate time to discuss the theoretical construction of environmental code system.We should find out two transformations of expectation to constructive logic and constructive expression with the ideal prospect and operation pattern that the environmental code system hopes to achieve as the entry point.The first is to concretize constructive expectations into the constructive principles of"moderate"systematization and"moderate"openness,and the internal logic of system determination and system arrangement;the second is to turn the construction expectation and logical reality into the delineation of the content,the design of the overall framework structure and the determination of the text context in the environmental code system.
