社会主义核心价值观融入司法裁判的方法论--以“狼牙山五壮士”案为例

On the Legal Methodology for Integrating Socialist Core Values into Judicial Decision-Based on the Case of“Five Warriors in Langya Mountain”

社会主义核心价值观融入个案司法裁判的关键在于法律方法。从“狼牙山五壮士”案中,我们发现了社会主义核心价值观融入个案司法裁判的三种方法。社会主义核心价值观是影响个案司法裁判的社会性因素,也是司法者价值“前见”和“法感”的组成部分,能够为个案中的法律发现提供根据;社会主义核心价值观是当代中国主流价值观的原则化和体系化表达,是司法者处理竞争性价值时必须考虑的因素,为疑难案件中的价值权衡提供对象;社会主义核心价值观还经常与制度内后果中的法律目的、制度外后果中的正义感和共同善相关,能够为后果主义法律推理中的后果判断提供参数。这些方法对于将社会主义核心价值观融入其他疑难案件的司法裁判具有启发意义。

Effective legal methodology is of utmost importance for integrating socialist core values into the judicial decisions of particular cases.We discover three methods based on the case of“Five Warriors in Langya Mountain”.Socialist core values are social factors influencing particular judicial decisions and the constituent parts of the preunderstanding and hunch of judges,which can supply bases for legal discovery.Socialist core values,the principled and systematic representation of current main values in China,should be taken seriously when judges deal with contested values,so that they can supply references for value balancing.Socialist core values are often related with legislative purpose,justice and common goods outside law,so they can be used as parameters for consequence judging during the consequential legal reasoning.These methods are also instructive when we try to integrate socialist core values into other hard cases.
