论代修复制度在土壤损害案件中的司法适用

On the Judicial Application of the Agent Remediation System in Soil Damage Cases

代修复制度借鉴于行政代履行制度,但二者在实施主体、启动条件及实施程序等方面有所不同。在土壤损害案件中,适用代修复制度有利于被损害的土壤生态环境得到及时有效的修复,同时还能促进土壤修复产业的发展。在制度外部,现行代修复和代履行制度存在司法与行政功能重叠、法治成本过高等问题,需要探索和设计科学合理的衔接机制。在制度内部,目前在代修复适用前提、代修复人确定、代修复费用存放管理、代修复监督等四个方面存在不足,需要通过明确土壤损害案件代修复适用的条件、确定土壤代修复人的选择方式、完善代修复费用存放管理机制和土壤代修复监督机制等,使代修复制度在土壤修复中更好地发挥作用。

The agent restoration system is borrowed from the administrative agency performance system,but they are different in terms of implementation subject,starting conditions and implementation procedures.In the case of soil damage liability disputes,the application of the agent remediation system is conducive to the timely and effective restoration of the damaged soil ecological environment,and it can also promote the development of the soil remediation industry.Outside the system,the current system of agency repair and agency performance has problems such as overlapping judicial and administrative functions,and excessive legal costs.It is necessary to explore and design a scientific and reasonable linkage mechanism.Inside the system,there are deficiencies in four aspects:the prerequisites for the application of the repair agent,the determination of the repairer,the storage and management of the repair cost,and the supervision of the repair.It is necessary to clarify the conditions applicable to the repair of soil damage cases,determine the selection method of the soil repairer,and improve the storage management mechanism of the repair cost and the supervision mechanism of the soil repair,so that the generation restoration system can play a better role in soil restoration.
