历史法学的提出是萨维尼回应19世纪德国法学构建“法律科学”的结果。萨维尼历史法学在总体上是在反对17~18世纪理性主义的大背景下产生的,其理论基础是以经验主义和浪漫主义为底色的历史主义,辅以时代赋予德意志的文化民族主义。萨维尼历史法学的内在逻辑经历了一个从理性制定法到民族精神,再从民族精神到法律科学,最终达至科学的法的过程。

The proposal of historical law is the result of Savigny s response to the establishment of science of law of German law in the 19th century.Savigny s historical law is generally produced against rationalism in the 17th and 18th centuries.Its theoretical basis is historicism based on empiricism and romanticism,which was supplemented by cultural nationalism conferred by the times on Germany.The internal logic of Savigny s historical jurisprudence has gone through a process from rational nature law to national spirit,then from national spirit to science of law,and finally to scientific law.
